Tunisia: Towards MIP’s direct bankruptcy

The Extraordinary General Meeting (EGM) of MIP, to be held on August 23, 2024, will decide whether to file for the direct bankruptcy of the company.

According to the draft resolutions to be submitted to the EGM, the company points out that its current situation is characterized by a total cessation of activity, the absence of all staff and, above all, the cessation of payments.

It should be recalled that in 2020 the auditor, Nejib Marrakchi, notified the Tunis Court of First Instance of the company’s economic difficulties. However, on May 22, 2022, the court rejected the auditor’s request on the grounds of territorial incompetence.

In such a situation, the company should file for direct bankruptcy without going through the judicial arrangement procedure.
