Commercial disputes: A Maghreb arbitration court in the making?

President of the International Academy of Arbitration and Mediation of Carthage, Dr. Inès Ben Nasser, said that the first Maghreb Congress on International Arbitration and Mediation, held under the theme “Commercial Arbitration Between Transformations and Maritime Contracts,” aims to explore modern and effective legal mechanisms for resolving commercial disputes and protecting investors amid profound economic and geopolitical changes.

Speaking to Mosaïque FM, she explained that the event brings together arbitration and mediation experts and specialists from Maghreb and Arab countries to examine the impact of current international crises, particularly geopolitical tensions, on the execution of international commercial contracts and investment flows.

She added that the congress is expected to produce a series of practical recommendations, the most notable being the proposal to establish a Maghreb Arbitration Court bringing together legal expertise from across the region.

The court would serve as a regional alternative capable of resolving commercial and arbitration disputes more efficiently while reducing reliance on costly international arbitration centers.

Ben Nasser stressed that the initiative is strictly professional and technical in nature. Its objective is to strengthen the arbitration framework across the Maghreb and promote local expertise in handling major commercial and investment disputes.
